Privacy Policy

How we collect, use, disclose and protect your personal and credit information — and the choices you have.

1. Who we are

Transport & Machinery Finance (“TMF”, “we”, “us”) is a trading brand of Commercial Introducer Pty Ltd (ABN 71 673 108 033), part of the Sydney Commercial Finance group of companies. Sydney Commercial Finance is an authorised credit representative (Credit Representative Number 520261) under Australian Credit Licence 531308.

We are a commercial finance broker. We arrange equipment, vehicle and business finance by matching your needs to lenders and credit providers across our panel. This policy explains how we handle your personal information in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”), the Australian Privacy Principles (“APPs”) and, where relevant, the credit reporting provisions in Part IIIA of the Privacy Act.

2. The information we collect

The personal information we collect depends on how you deal with us. It may include:

  • Contact and identity details — your name, business name, email, phone number and location.
  • Finance enquiry details — the asset you want to finance, the amount, the structure (term, deposit, balloon), any rate you have been quoted, and similar information you provide through our forms, calculators and tools.
  • Financial and credit information — where you progress to a finance application, information about your business and finances, bank statements, asset and liability details, and credit information (such as your credit history and consumer or commercial credit scores).
  • Technical and usage information — information collected automatically when you visit our website, such as your IP address, device and browser type, and how you use the site (via cookies and analytics tools).

You do not have to provide your information, and you may deal with us anonymously or using a pseudonym where it is lawful and practicable. However, if you do not provide the information we ask for, we may not be able to arrange finance or respond to your enquiry.

3. How we collect it

We usually collect personal information directly from you — when you complete a form, use one of our tools (such as the Rate Check or Finance Calculator), call or email us, or apply for finance. We may also collect information from third parties, such as your accountant or referrer (with your authority), lenders and credit providers, and credit reporting bodies, where this is permitted by law.

4. Why we collect, hold, use and disclose it

We use and disclose your personal information to:

  • respond to your enquiry and provide you with indicative figures and information;
  • assess your finance needs and arrange, submit and manage finance applications on your behalf;
  • disclose your application to lenders, credit providers and insurers on our panel so they can assess and price the deal;
  • verify your identity and meet our anti-money-laundering, responsible-lending and other legal obligations;
  • administer our relationship with you and improve our website, tools and services;
  • send you information we think may be relevant (see Direct marketing below).

5. Disclosure to lenders and other parties

As a finance broker, the core of what we do is sharing your application with lenders and credit providers so they can make you an offer. We may also disclose your information to: other companies within the Sydney Commercial Finance group; our referral partners (where you came to us through one); credit reporting bodies and credit providers; our professional advisers; and government or regulatory bodies where required by law. We do not sell your personal information.

6. Credit information

Where your enquiry becomes a finance application, we may collect, use and disclose credit information and credit eligibility information in accordance with Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code. This may include obtaining information about you from, and disclosing information about you to, credit reporting bodies and credit providers for the purpose of arranging your finance. 7. Overseas disclosure

Some of the service providers we use (for example, cloud hosting, customer-relationship and email tools) may store data on servers located outside Australia, or may be operated from overseas. Where this is the case, we take reasonable steps to ensure your information is handled consistently with the APPs.

8. Direct marketing

With your consent, or where otherwise permitted by law, we may send you finance insights, market updates and offers (for example, our Monday Brief) by email or other electronic means. Every marketing message includes an unsubscribe option, and you can opt out at any time by using that option or by contacting us using the details below. We comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth). We will not use your information for unrelated marketing without your consent.

9. Cookies and analytics

Our website uses cookies and analytics tools to understand how the site is used and to improve it. You can set your browser to refuse cookies, though some parts of the site may not work as intended if you do.

10. How we keep your information secure

We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure — including access controls and secure storage. When we no longer need your information and are not required by law to keep it, we take reasonable steps to destroy or de-identify it.

11. Accessing and correcting your information

You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete or misleading. Contact us using the details below. We will respond within a reasonable period. There is no fee for making a request, although we may charge a reasonable cost for giving access in some cases.

12. Complaints

If you believe we have breached the APPs or mishandled your information, please contact us first using the details below so we can investigate and respond. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.

13. Changes to this policy

We may update this policy from time to time. The current version will always be available on this page, with the “last updated” date shown above.
